Off-Plan Building: Why Are Purchases and Sales and Building Permits "Freezing"?

The Greek real estate market and the construction sector are facing an unprecedented investment “slowdown” in areas outside the urban plan. Thousands of property owners and investors are essentially trapped, as the possibility of building on countless plots of land has been called into question.

What is the root cause? The complete lack of a clear and unified institutional framework that defines which roads are legally considered public.

Today, having a “frontage” on a recognized street is a mandatory requirement for obtaining a building permit. Without it, your property risks automatically losing the right to construct a building.


Chaos in Urban Planning (YDOM)

So far, building departments across the country have been operating without a common "roadmap".

  • Inequality and uncertainty: Two identical properties in different municipalities are treated according to completely different criteria.

  • Maps vs. Legal Validity: Although road network surveys have been completed in many areas, simply depicting a road on a map does not automatically imply its legality.


How Will the Legality of a Road Be Determined?

The solution lies with the Ministry of Environment and Energy (YPEΝ), which is expected to issue a relevant Presidential Decree. The roads will be designated based on strict and objective technical data, such as:

  1. Historical aerial photographs (mainly from before 1977).

  2. Historical cartographic material from the Army Geographical Service (AGS).

  3. Official data from the National Land Registry.

  4. Documents from public authorities proving that the road was built or systematically maintained by a government agency.

⚠️ Please note: Even if you own a plot of land larger than 4 stremmata, if the access road fails to meet the above “criteria,” the property loses its buildability. This leads to an immediate and drastic drop in its market value—even if it has been used for residential purposes for decades or is connected to water and electricity networks!

The 4 Major Market Challenges

The transition to the new system is not straightforward and is fraught with serious obstacles:

  • 🏛️ Understaffing of Urban Planning Departments: Significant delays in the review of specialized topographic diagrams.

  • ⚖ ️ Legal Risk at the Council of State: The Council of State’s strict stance on off-plan construction leaves open the possibility of new annulments in the future.

  • 💸 High Costs for Property Owners: Searching for historical aerial photographs and commissioning specialized engineering studies place a significant financial burden on property owners.

  • 📉 "Stall" on Investments & Financing: Major tourism investments and renewable energy projects are on hold, as banks refuse to finance projects on land with uncertain zoning status.


Conclusion: What does all this mean for you?

Until the institutional ratification of the road network is completed, any sale, transfer, or issuance of a building permit outside the plan carries a high risk.

The market is in a holding pattern, and sound technical and legal guidance is more essential than ever.
